Terms of Service

These Terms of Service ("Terms") govern your use of the GrammarPatch mobile app and this website (together, the "Service"), provided by sydacos GmbH, Hasenböge 17, 21514 Klein Pampau, Germany ("GrammarPatch", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

GrammarPatch is a language-learning aid for intermediate English learners. It diagnoses recurring tense and preposition mistakes, explains the rules behind them, and helps you practice them through short exercises and spaced review. GrammarPatch is not a course, a certified language assessment, or a professional translation or proofreading service, and its output should not be relied upon as such.

2. Your account

You need an account to use most features. You are responsible for keeping your sign-in credentials secure and for activity that occurs under your account. You must provide accurate information and be old enough to enter into these Terms under the laws of your country. Notify us promptly if you believe your account has been accessed without authorization.

3. Subscriptions, trials, and cancellation

GrammarPatch offers a free tier with limited use and paid subscriptions that unlock unlimited features. Paid plans are billed as recurring subscriptions:

• Monthly — USD 9.99 per month.
• Yearly — USD 59.99 per year.
• Free trial — a 7-day free trial is available for new subscribers. Prices shown are in US dollars; local prices and currency are set by the App Store and may vary.

Subscriptions are sold and processed through the Apple App Store and are subject to Apple's terms. Payment is charged to your Apple account at confirmation of purchase. Unless you cancel at least 24 hours before the end of the current period (or before the end of the free trial), your subscription renews automatically and your Apple account is charged for the next period. You can manage or cancel your subscription, and turn off auto-renewal, at any time in your Apple App Store account settings. If you cancel a free trial before it ends, you will not be charged. Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds are handled by Apple in accordance with App Store policy. Statutory withdrawal rights under EU consumer law remain unaffected where they apply.

4. Acceptable use

You agree to use the Service only for lawful, personal learning purposes. You must not:

• submit content that is unlawful, infringing, or that contains other people's personal data without a lawful basis;
• attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the Service or its infrastructure;
• use the Service to build a competing product or to scrape or bulk-extract content;
• misuse the AI features, including attempts to generate harmful, deceptive, or abusive output.

5. Your content

You keep all rights to the text you submit ("Your Content"). You grant us a limited license to process Your Content solely to operate and provide the Service — for example, to diagnose your mistakes and generate your practice — as described in our Privacy Policy. We do not use Your Content as a public example without your explicit permission.

6. Intellectual property

The Service, including its software, design, content, and the GrammarPatch name and logo, is owned by us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own learning. All rights not expressly granted are reserved.

7. AI output and no warranty

The Service uses automated AI to generate diagnoses, explanations, exercises, and feedback. AI output can be incomplete or occasionally wrong and is provided to support your learning, not as authoritative or professional advice. To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

8. Limitation of liability

Nothing in these Terms limits our liability for injury to life, body, or health, for intent or gross negligence, or for any other liability that cannot be excluded under mandatory German law (including the German Product Liability Act). Subject to that, our liability is limited as follows: for slight negligence, we are liable only where we breach a material contractual obligation (an obligation whose fulfillment is essential to the proper performance of the contract and on which you may reasonably rely), and in that case our liability is limited to the foreseeable damage typical for this type of contract. We are not otherwise liable for slight negligence.

9. Termination

You may stop using the Service and delete your account at any time from Settings in the app. We may suspend or terminate your access if you materially breach these Terms or use the Service unlawfully. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will survive.

10. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Your continued use after changes take effect constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rights of your country of residence remain unaffected. Where permitted by law, the courts at our registered seat have jurisdiction for disputes with businesses.
